TERMS AND CONDITIONS FOR THE SALE OF ARTWORK

 

1. Introduction

These terms and conditions (the “Terms and Conditions”) apply to the sale of any artworks (the “Artwork”) from www.jolathwood.co.uk “the website” by Jo Lathwood (the “Artist”) to you (“the Buyer”).

2. Title and Risk

2.1 As soon as the purchase price is paid in full, the buyer will become the legal owner of the Artwork and, upon such payment, the buyer will be responsible for the Artwork and the risk of damage to or loss of the Artwork will pass to the buyer.

2.2 The buyer hereby covenants not intentionally to alter, damage or destroy the work.

3. Ownership of the Artwork Copyright

3.1 Copyright of the Artwork remains the property of the Artist.

3.2 You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including any internet website for any purpose.

3.3 If you breach any of your obligations under paragraph 3.2. you agree that: (a) the payment of damages will not be a sufficient remedy to compensate the Artist for yourbreach; (b) the Artist may, apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and (c) the Artist may, contact the operator of any internet website on which the Artwork is being offered for sale or on which an image of the Artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.

3.4 If you wish to do any of the things mentioned in paragraph 3.2 then written permission is required from the artist (email: jolathwood@gmail.com)

4. Artist’s exhibition.

The buyer shall lend the work to the artist once in every twelve months for a maximum period of six weeks for the purpose of inclusion in a public exhibition of the artist’s works, if the artist gives the buyer reasonable written notice of his intention to do so together with documentary evidence
of insurance cover and prepaid carriage to and from the exhibition; provided that the artist ensures that the exhibiting institution identifies the work as belonging to the buyer.

5. Data Protection

5.1 The Artist will hold basic contact information about the buyer to ensure they can continue communication.

5.2 Artist and buyer shall notify each other in writing immediately of any change of contact details.

6. Store Policies

6.1 Returns: Refunds on all artworks are valid for 30 days after date of purchase. If you’re not happy with your artwork please get in touch via email jolathwood@gmail.com or the website’s contact page.

6.2 Shipping: All artworks over £100 will be shipped using Royal Mail special delivery (UK) and a tracking number will be provided to the buyer on receipt of full payment. For international postage, a similar service will be provided.

7. Originality.

7.1 The artist hereby covenants that the work is his/her original and that he/she shall not produce a replica of it.

7.2 If the work is one of an edition, the artist hereby covenants that the size of edition shall not be increased.

8. Rights of Third Parties

No person other than the buyer and the Artist have any rights under these Terms and Conditions.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.
